1.     Terms and Conditions of Warranty

Pen K Inter Trading Company Limited (“Company”) warrants that this product is freeof defects in material and manufacturing process according to the terms and conditions described below:

1.1     This warranty covers specifically the product distributed by the Company or the Company’s authorized dealers andsuch productis purchased and being used for household purposes in Thailand only.

1.2     This warranty covers the original purchaser,who purchasesthe product from the Company or the Company’s authorized dealer,whose name appearedinthe warranty system of the Company.

1.3     This warranty covers the purchaser who registersthe warranty in the warranty systemof the Company and receivesthe confirmation from the Company or an electronic mail (email) or short message service (SMS) confirmation of such registration from the Company.

1.4     To validate coverage, the purchaser must keep and maintain all the proof of purchase including but not limited to warranty card and/or sales receipts/tax invoices throughout the warranty period. The purchaser mustpresent those completeddocuments with no edition to the customer service officers as an evidence of product purchasingdate. The Company reserves the right to refuse to service any purchaser whofails to show those mentioned documents to the customer service officers and the Company shall have no liability whatsoever with respect thereto.

1.5     This warranty is not transferable.


2.     Warranty Period

2.1     All kind of products are warrantedfrom the date specified in the warranty card and/or sales receipts/tax invoices or as from the product delivery date in case of special ordered products –as the case may be.Warranty period and terms & conditions of warranty of each product are as shown in the attachment –Warranty Periodand shall form an integral part hereof.

2.2     The warranty period willautomaticallybe decreased by half if such product is used for demonstration, displaypurpose or it is a discount productsold in any clearance sales.

2.3     The warranty period will automatically terminate on the expiryof the warranty periodeven if the producthasnot been fully used or installed.


3.     Warranty Claim Procedure and Requirement

3.1     If the purchaser receives defectiveproduct and/or incomplete equipment, the purchaser must notify the Company or the Company’s authorized dealer within seven (7) days from the product receiving date provided that it’s a sole discretion of the Companyto replacethe productand/or supply the missing equipment to the purchaser. If the purchase does not inform the Company within such period, it shall be deemed that the purchaser has received the product entirely and completely, and the Company reserves the right to reject the warrantyaccording to this clause.

3.2     During the warranty period, all claims of defective product must be made by informing the Company or the Company’s authorized dealer within thirty (30) days of the discovery of the defectprovided that the purchaser had already registered the warranty in the warranty system of the Company and received the confirmation from the Company or an electronic mail (email) or short message service (SMS) confirmation of such registration from the Companyaccording to clause 1.3.The purchaser also must present the warranty card and proof of purchase to the Company according to clause 1.4. The Company reserves the right to refuse to provide warranty to any purchaser who fails to register the warranty in the warranty system of the Company and/or fails to present the warranty card and proof of purchase to the Company.

3.3     The purchaser with its own costs and expenses shall bring the defective product to the Company for theCompany’sexamination. If the defective product has been installed and fixed with residence or its nature is inconvenienceto move, the purchaser must permit the Company or the Company’s authorized dealer to inspect the defective productwhere it’s located at the agreed mutual date and time.

3.4     The Company shall examine the defect of the product and itisa sole discretion of the Company to determine whether such defect is within the warranty or not.

3.5     If the defect of the product is covered under the warranty, the Company shall repair and/or replace the defective part at no cost. The replaced part under this warranty will become the property of the Company. The repair and replacement of spare partswill not result in an extension of the valid warranty period; the original warranty period still applies.

3.6     The maximum responsibility of the Companyin relation to this warrantyis the repair and/or replacement of the defective part in order to keep the product usable, the Company will not substitute a new producttothe purchaser for whatever reason.

3.7     The Company’s decisionregarding to any defect, repair and/or replacement of spare parts or any other matters relating to the warrantyis conclusive, and the purchaser irrevocably agrees tocomply with the Company’s decision.


4.     Exclusion of Warranty

This warranty does not cover the following matters:

4.1     The defect occurs after the warranty period has expired.

4.2     The purchaser fails to register the warranty in the warranty system of the Company and/or fails to present the warranty card and proof of purchase to the Company.

4.3     In any event, a warranty card and/ora proof of purchase isamended or destroyed.

4.4     Serial number of the product is amended, erased, deleted or destroyed.

4.5     The purchaser fails to notify the defect within the specified period.

4.6     Defect and damage resulting from the installation, modification, connection, repair, maintenance of the productby any person whoisnot the Company’s personnel.

4.7     Usingofnon-standard or misaligned plugs, external extension equipment or extension cord and electronic circuit breaker, applying incorrect electric voltage, water pressure and gas pressure contrary to the description specified in the instruction manual.

4.8     Failure to strictly observe the product instruction manual.

4.9     Defect and damageresulting from improper transportation or storage of product which is not the responsibility of the Company.

4.10     Defect and damage caused by wilful misconduct, accident,and riot,external factors, natural disaster and environment such as adulterated substances, sweat, liquids, food, moisture, lightning, unstable electric current, earthquakes, floods, aggressive environmental influences or chemicaldust, etc.

4.11     Defect and damage resulting from the purchaser's failure to maintain and clean the product as specified in the product instruction manual.

4.12     Defect and damage resulting from the use of material or chemical contrary to the product instruction manualeither by wilful misconduct or negligence.

4.13     Defect and damage resulting from misusing the product including but not limited to the use of household product for commercial or industrial purpose or the use of product for any experimentor testing.

4.14     Scratches and damage on the outer surfaceand exterior component resulting from normal use.

4.15     General deteriorationor normal wear and tear fromnormaluse,cracks, corrosion, rusting or stains as well as damage caused by animal or insect bites.

4.16     Fragile items or parts such as glass or decorated items or consumables items such as light-bulbs, batteries, air filters, water filters, water filterschemical, or other consumables such as rubber seals orrubberhosesetc.


5.     Limitation of Liability

The Company shall not be liable for indirect loss, special damages, consequential damages, punitive damages, special circumstances loss or economic loss or any lossincluding loss of profit, loss ofbenefitorloss of business opportunityor loss, disappearance, deletionor edition of data stored in software or in anykindarising out of or in connection with the warranty (including the service of the Company under warranty).

Liability of the Companyunder or in connection with the warranty (including the service of the Company under warranty), is limited tothe cost of repair or cost of replacement of parts whichever is lower. The Company shall also not be liable for any other warranties (whether explicitly expressed or explicitly implied) in relation to the product including but not limited to the implied warranty for commercial use or for any specific purpose.

The Company shall not be responsible or liable for wages or other expensesin relation to the installation, repair or substitutionof the product or loss or damage of anything that the Company or its authorized dealer doesnot sell to the purchaser.
